Of Covenants And Restrictions
These documents were written by Midway Road Associates,
Ltd, the developer of Glen Meadows on January 13, 1992.
They are filed of record in the Collin County, Texas Deed
Records under file # 92-0002532. The Collin County
Courthouse is located in McKinney Texas.
When someone buys a home in any subdivision, the title
insurance company where they close the real estate
transaction does a property search to discover liens,
deeds, restrictive covenants, etc. and then issues a title
insurance policy insuring good and feasible title for each
home owner in order for the sale to consummate; that is
when the homebuyer is borrowing money to buy the property.
Most all sales include a title policy. The title company is
supposed to provide a copy of the 'Declaration of Covenants
and Restrictions' to any customer seeking a title insurance
policy. It is provided to the new homebuyer along with the
title commitment, which the State of Texas and/or purchase
contract requires the title company todeliver to the buyer
within 20 days after the effective date of the contract.
All owners in Glen Meadows should have a copy of the
'Declaration of Covenants and Restrictions' as a result of
purchasing their property.
It is recommeded that home owners wishing a copy of the
'Declaration of Covenants and Restrictions' do one of two
things:
1. Look in the title company folder given at closing or
look at the title commitment package sent to you prior to
closing.
2. Contact the title company where you consummated the
purchase of your property, and ask them for a copy of this
document.
It is not the responsibility of the homeowners association
to provide this information. In fact, the State of Texas
allows accredited home owner associations to charge up to
$250 to provide the subdivision information to a requesting
party. This is usually the case when a property sells and
the association is mandatory.
